This agreement is effective without the need for a physical signature and governs your relationship with VEX Performance.

Release from Liability: As a user, you recognize that modifying a vehicle carries inherent risks, which may include damage to the vehicle. Consequently, you release VEX Performance, its parent company, subsidiaries, officers, directors, promoters, sponsors, employees, and agents from any liability. You also agree to indemnify and hold them harmless against any loss, liability, damage, or cost resulting from modifications performed on your vehicle. This release covers any bodily injury, death, or property damage that might occur due to the negligence of VEX Performance or others while operating the vehicle. By accepting these terms, you assume full responsibility for these risks.

Product Usage and Warranty Limitations: All products sold, installed, or modified by VEX Performance, as detailed on www.vexperformance.com, are designed for high-performance, racing, and off-road use only. Due to the nature of these products and the variables involved in their installation and usage, they are provided without any warranty, either expressed or implied. VEX Performance explicitly disclaims all warranties, including those of merchantability or fitness for a particular purpose, along with any other obligations or liabilities arising from the sale, installation, or use of its products and services. VEX Performance is not responsible for any damages, whether direct or consequential, caused by defects or failures of its parts, and will not cover labor, transportation, or related costs resulting from such issues. In the event that VEX Performance requires legal services, the buyer agrees to cover all associated costs, including court fees and attorney expenses.

Compliance with Legal Standards: Modifying a vehicle with products from VEX Performance for use on public roads may violate Canadian and/or Provincial laws, particularly those related to safety and emissions standards. The purchaser assumes all risks and expenses for such unlawful operation. VEX Performance (www.vexperformance.com) shall not be liable for any consequences stemming from such unlawful vehicle operation.

Waiver and Risk Acknowledgment: Customers of VEX Performance (www.vexperformance.com) voluntarily waive and release the company from all claims related to personal injury, property damage, and other potential losses or damages arising from the use of its services. Customers acknowledge and fully understand the risks involved in installing and using high-performance, racing, or off-road parts at the time of purchase.

Validity of Agreement Provisions: Should any part of this agreement be declared void, illegal, or invalid by a court of competent jurisdiction, the remaining portions of the agreement remain valid and unaffected. The void, illegal, or invalid part is not considered a part of this agreement.
